The legal description of the land is Lot 2 and 3, Deeds 1763, Record of Title NL56/85 (pending issue of new Records of Title for Lots 1 to 4 under subdivision consent RM130346V1), and Lot 2 DP 511511
The proposal is for a change to the layout of the existing activity on the Olive Estate Lifestyle Village site (the existing site), and to construct and establish community activity in the Residential Zone on the land to the south east (the Hill Street block). The proposal includes associated activities and subdivision.

The changes of conditions of consent RM120928V1 (for the existing Olive Estate village) sought are to enable the removal of the consented care facility, and the construction of extra residential units with an amended site layout.
This is needed to construct a compact density development (the residential villas and apartments) and a community activity (the care facility) off Hill Street, while not providing public reserve to the standard of the Tasman Resource Management Plan (TRMP).

This consent for land disturbance is sought for the bulk earthworks in the Land Disturbance Area 1. These are associated with the construction of the compact density development and care facility, and include the decommissioning and filling of an existing pond.
The water permit sought is for the ‘take’ of water associated with the de-watering of a pond.

Attachment B to her evidence are amended plans for the care facility building that replace all previous drawings.
This is summarised as (in relation to visual simulation B), "a lower floor level of 57.750 due to a smaller foundation and being excavated down by 350mm, a reduced height of the building by 560mm (with height taken out of each floor); and with a redesign of the Crows Nest".

The hearing was reconvened on 10 May 2021. The order and scope of evidence was set by the Commissioners in their minute no 3.

The Commissioners closed the Hearing on 28 May 2021. While they expected to issue notice of their decision by 21 June 2021 it was issued on Thursday 22 June 2021.

The Resource Management Act lets the applicant for a notified resource consent stop the processing of their application for up to 130 working days.
When the time runs out Council must restart processing or return the application, though Council can consider extending the period (see sections 37 and 37A).
Council will get in touch with every submitter when the process restarts or after any decision about extending timeframes.
The 130 working days 'as of right' suspension is reduced by the number of days for some other previous stoppages, such as how many days they needed to answer Council's requests for more information.
The following applies if you are a trade competitor of the applicant.
Your right to make a submission may be limited by the trade competition provisions in Part 11A of the Resource Management Act 1991.
