Wetlands work notification form

Complete this form to let us know about certain activities you are planning to carry out in or near a natural wetland.

Under the National Environment Standards (NES) for Freshwater you need to notify us of certain activities you are planning to carry in or near a natural wetland.

The following activities are regulated by the National Environmental Standards for Freshwater for the purposes of restoring Natural Wetlands, Scientific Research, maintenance of Wetland utility structures or specified infrastructure, moss harvesting and natural hazard works.

  • Vegetation clearance OR earthworks within, or within a 10m setback from, a natural wetland.
  • Taking, use, damming, diversion, or discharge of water within, or within a 100m setback from, a natural wetland.
  • Harvesting sphagnum moss from within a natural wetland.

The regulations are found on the New Zealand Legislation website(external link). Regulations 37-56 are relevant to wetland works.

Certain activities are permitted (i.e. do not require consent) provided specified conditions are met. These conditions are found in Regulation 55 and we recommend you assess your proposal against these conditions.

A requirement of Regulation 55 is that the person responsible for undertaking the activity must provide Tasman District Council with notice of the activity at least 10 working days before commencement.

A requirement of Regulation 48 Sphagnum moss harvesting, is that prior notice must be provided at least 20 working days before the activity is undertaken. Prior notice must include the information requested in this form.

* A wetland utility structure means a structure placed in or adjacent to a wetland whose purpose, in relation to the wetland, or recreation, education, conservation, restoration, or monitoring. Examples include jetties, boardwalks, walking tracks, signs, bird watching hides, monitoring devices, and mai mai.

** Specified infrastructure means:

  • Infrastructure that delivers a service operated by a lifeline utility (as defined in the Civil Defence Emergency Management Act 2002)
  • Regionally significant infrastructure identified as such in a regional policy statement or regional plan
  • Any public flood control, flood protection, or drainage works carried out by or on behalf of a local authority, including works carried out for the purposes set out in section 133 of the Soil Conservation and Rivers Control Act 1941; or for the purpose of drainage by drainage districts under the Land Drainage Act 1908.
